Hands Free Laws and Employer Liability
Over the past 6 years, states have been instituting laws addressing the problem of driver cell phone use and traffic safety. Many states have defined hands-free laws and produced legislation that bans cell-phone use completely. Although employer responsibility isn't specifically defined in the cell phone legislation, there have been an increasing number of lawsuits relating to employer responsibility regarding mobile cell-phone use for employees. The implementation of a vehicle use policy that addresses cell phone use is an important first step in limiting employer liability. To read more about the new cell-phone laws that may impact your organization, please visit our Employer Liability page.

Washington State Hands Free Driving Law
Washington State has a couple of new driving laws coming in 2008. One of the new laws is a text messaging ban. Washington may be the first state to ban text messaging while driving, however I don't believe they will be the last. The other new law is the hands-free driving law that prohibits the use of a cellular device while driving unless the driver is using a hands-free device. A hands-free device would be something like a bluetooth headset, car-kit or a wired headset connected to your cell phone. If you would like more information on the new Washington State driving laws check out our Washington State Page.

The Blackberry Pearl 8100

I have used the Blackberry Perl 8100 for about 6 months now. Since then the iPhone has been released and it has one feature I really wish the perl had, the touch keyboard. The Perl has a small keyboard, so if you have big fingers and bad eyes, you may struggle a bit with this device. For some the size is perfect, it’s lightweight and small.
I can fit the Perl in my shirt pocket with ease without having to worry about my shirt being pulled down by the weight.
Also, I added a 1 GB Media Card to my perl and I bought a cheap pair of headphones so I can listen to my downloads.
Also, I added a 1 GB Media Card to my perl and I bought a cheap pair of headphones so I can listen to my downloads.
I have e-books and MP3’s that I listen to on a regular basis. As a MP3 Player the choices are limited with the perl, you can play the whole folder, skip a song and repeat a song. So don’ think about trading in your iPOD for the Blackberry 8100.
The phone is solid, I have had no problems with it, I use a wired headset instead of the bluetooth because I like the sound quality better. I receive my email and appointments over the air by syncing with our GroupWise server at work. I’m very happy with the product at this point, but I sure would like to try one of the iPhones!

Bluetooth - One way to become hands-free
While the new hands-free laws across the US may fall short of perfection, you may not be willing to take the risk of getting a ticket. Using a bluetooth earbud like the one pictured below is one way to comply with the hands-free law in your state.

There are also other hands-free options to consider besides the bluetooth earbud, like the more affordable wired headset or the more expensive bluetooth car-kit. If you are interested in reading more about all of your hands-free options check out our "Being Hands Free" page.

The California Teen Cell Phone Ban
Another new law in California in 2008 is Senate Bill 33, sponsored by the same Senator that sponsored the California Hands Free Law (SB1613) Senator S. Joseph Simitian. The law prohibits drivers under the age of 18 from using a wireless telephone while operating a motor vehicle.
